The expectation is that DBSI will declare bankruptcy at any time. (Newspapers and TV are reporting the class action lawsuit alleging fraud and racqueteering as well as investigations by law enforcement orgs). DBSI canceled Friday's calls with TICS: note canceled, not postponed. DBSI is under court order to pay us November's rent by the thirteenth.
If there is a call Wednesday, here are my questions.
1) Can you give us a date certain for payment of September and October's rent (including 5% penalty). Please answer yes or no.
2) Where can we send our invoice for legal fees you are responsible for under our TIC agreement?
3) Are you going to contest our termination of our relationship with you? Yes or No?
4) Please summarize to date what you have done to comply with the Restraining Order requirements.
I am willing to initiate a conference call for anyone interested. I am suggesting 8:30 EST.
