Even though LeasCo and DBSI are Idaho companies, a lawyer i consulted says the following: "It doesn't matter where those companies are chartered to enforce a guarantee or evict a lessee. A NC lawyer would negotiate, and if necessary, file suit. A state court in NC would have jurisidction over the law suit because the companies are doing business in NC. "
We should be looking both to evict and to enforce the guarantee, i.e. full payment.
Also, since RB Richard Ellis is one of the 20 largest property manager's in the world, it should obviate any concern about assumption of the mortgage by Wells Fargo.
